DIRECTIVE 2012/19/EU OF THE EUROPEAN PARLIAMENT

AND OF THE COUNCIL

of 4 July 2012

on waste electrical and electronic equipment (WEEE)

Article 1

Subject matter

This Directive lays down measures to protect the environment and human

health by preventing or reducing the adverse impacts of the generation and

management of waste from electrical and electronic equipment (WEEE) and

by reducing overall impacts of resource use and improving the efficiency of

such use in accordance with Articles 1 and 4 of Directive 2008/98/EC,

thereby contributing to sustainable development.

Article 2

Scope

1. This Directive shall apply to electrical and electronic

equipment (EEE) as follows:

(a) from 13 August 2012 to 14 August 2018 (transitional period),

subject to paragraph 3, to EEE falling within the categories set

out in Annex I. Annex II contains an indicative list of EEE

which falls within the categories set out in Annex I;

(b) from 15 August 2018, subject to paragraphs 3 and 4, to all EEE. All

EEE shall be classified within the categories set out in Annex III.

Annex IV contains a non-exhaustive list of EEE which falls within

the categories set out in Annex III (open scope).

2. This Directive shall apply without prejudice to the requirements of

Union legislation on safety and health, on chemicals, in particular

Regulation (EC) No 1907/2006 of the European Parliament and of

the Council of 18 December 2006 concerning the Registration,

Evaluation, Authorisation and Restriction of Chemicals (REACH),

establishing a European Chemicals Agency (

), as well as of specific

Union waste management or product design legislation.

3. This Directive shall not apply to any of the following EEE:

(a) equipment which is necessary for the protection of the essential

interests of the security of Member States, including arms,

munitions and war material intended for specifically military

purposes;

(b) equipment which is specifically designed and installed as part of

another type of equipment that is excluded from or does not fall

within the scope of this Directive, which can fulfil its function only

if it is part of that equipment;

4. In addition to the equipment specified in paragraph 3, from

15 August 2018, this Directive shall not apply to the following EEE:

(a) equipment designed to be sent into space;

(b) large-scale stationary industrial tools;

specifically designed and installed as part of those installations;

(d) means of transport for persons or goods, excluding electric

two-wheel vehicles which are not type-approved;

(e) non-road mobile machinery made available exclusively for profes

sional use;

(f) equipment specifically designed solely for the purposes of research

and development that is only made available on a business-to-

business basis;

(g) medical devices and in vitro diagnostic medical devices, where such

devices are expected to be infective prior to end of life, and active

implantable medical devices.

5. No later than 14 August 2015, the Commission shall review the

scope of this Directive set out in point (b) of paragraph 1, including the

parameters to distinguish between large and small equipment in

Annex III, and shall present a report thereon to the European Parliament

and to the Council. The report shall be accompanied by a legislative

proposal, if appropriate.

Article 3

Definitions

1. For the purposes of this Directive, the following definitions shall

apply:

(a) ‘electrical and electronic equipment’ or ‘EEE’ means equipment

which is dependent on electric currents or electromagnetic fields

in order to work properly and equipment for the generation,

transfer and measurement of such currents and fields and

designed for use with a voltage rating not exceeding 1 000 volts

for alternating current and 1 500 volts for direct current;

(b) ‘large-scale stationary industrial tools’ means a large size assembly

of machines, equipment, and/or components, functioning together

for a specific application, permanently installed and de-installed by

professionals at a given place, and used and maintained by profes

sionals in an industrial manufacturing facility or research and

development facility;

relectronicequipmentwhichiswastewithinthemeaningofArticle3(1)ofDirective2008/98/EC,includingallcomponents,sub-assembliesandconsumableswhicharepartoftheproductatthetimeofdiscarding;(f)‘producer’meansanynaturalorlegalpersonwho,irrespectiveofthesellingtechniqueused,includingdistancecommunicationwithinthemeaningofDirective97/7/ECoftheEuropeanParliamentandoftheCouncilof20May1997ontheprotectionofconsumersinrespectofdistancecontracts(1):(i)isestablishedinaMemberStateandmanufacturesEEEunderhisownnameortrademark,orhasEEEdesignedormanufacturedandmarketsitunderhisnameortrademarkwithintheterritoryofthatMemberState;(ii)isestablishedinaMemberStateandresellswithintheterritoryofthatMemberState,underhisownnameortrademark,equipmentproducedbyothersuppliers,aresellernotbeingregardedasthe‘producer’ifthebrandoftheproducerappearsontheequipment,asprovidedforinpoint(i);(iii)isestablishedinaMemberStateandplacesonthemarketofthatMemberState,onaprofessionalbasis,EEEfromathirdcountryorfromanotherMemberState;or(iv)sellsEEEbymeansofdistancecommunicationdirectlytoprivatehouseholdsortousersotherthanprivatehouseholdsinaMemberState,andisestablishedinanotherMemberStateorinathirdcountry.(1)OJL144,4.6.1997,p.19.02012L0019—EN—04.07.2018—001.001—5▼BWhoeverexclusivelyprovidesfinancingunderorpursuanttoanyfinanceagreementshallnotbedeemedtobea‘producer’unlesshealsoactsasaproducerwithinthemeaningofpoints(i)to(iv);(g)‘distributor’meansanynaturalorlegalpersoninthesupplychain,whomakesanEEEavailableonthemarket.Thisdefinitiondoesnotpreventadistributorfrombeing,atthesametime,aproducerwithinthemeaningofpoint(f);(h)‘WEEEfromprivatehouseholds’meansWEEEwhichcomesfromprivatehouseholdsandWEEEwhichcomesfromcommercial,industrial,institutionalandothersourceswhich,becauseofitsnatureandquantity,issimilartothatfromprivatehouseholds.WastefromEEElikelytobeusedbybothprivatehouseholdsandusersotherthanprivatehouseholdsshallinanyeventbeconsideredtobeWEEEfromprivatehouseholds;(i)‘financeagreement’meansanyloan,lease,hiringordeferredsaleagreementorarrangementrelatingtoanyequipmentwhetherornotthetermsofthatagreementorarrangementoranycollateralagreementorarrangementprovidethatatransferofownershipofthatequipmentwillormaytakeplace;(j)‘makingavailableonthemarket’meansanysupplyofaproductfordistribution,consumptionoruseonthemarketofaMemberStateinthecourseofacommercialactivity,whetherinreturnforpaymentorfreeofcharge;(k)‘placingonthemarket’meansthefirstmakingavailableofaproductonthemarketwithintheterritoryofaMemberStateonaprofessionalbasis;(l)‘removal’meansmanual,mechanical,chemicalormetallurgichandlingwiththeresultthathazardoussubstances,mixturesandcomponentsarecontainedinanidentifiablestreamorareanidentifiablepartofastreamwithinthetreatmentprocess.Asubstance,mixtureorcomponentisidentifiableifitcanbemonitoredtoverifyenvironmentallysafetreatment;(m)‘medicaldevice’meansamedicaldeviceoraccessorywithinthemeaningof,respectively,point(a)or(b)ofArticle1(2)ofCouncilDirective93/42/EECof14June1993concerningmedicaldevices(1)whichisEEE;(n)‘invitrodiagnosticmedicaldevice’meansaninvitrodiagnosticdeviceoraccessorywithinthemeaningof,respectively,point(b)or(c)ofArticle1(2)ofDirective98/79/ECoftheEuropeanParliamentandoftheCouncilof27October1998oninvitrodiagnosticmedicaldevices(2)whichisEEE;(o)‘activeimplantablemedicaldevice’meansanactiveimplantablemedicaldevicewithinthemeaningofpoint(c)ofArticle1(2)ofCouncilDirective90/385/EECof20June1990ontheapproximationofthelawsoftheMemberStatesrelatingtoactiveimplantablemedicaldevices(3)whichisEEE.(1)OJL169,12.7.1993,p.1.(2)OJL331,7.12.1998,p.1.(3)OJL189,20.7.1990,p.17.02012L0019—EN—04.07.2018—001.001—6▼B2.Inaddition,thedefinitionsof‘hazardouswaste’,‘collection’,‘separatecollection’,‘prevention’,‘re-use’,‘treatment’,‘recovery’,‘preparingforre-use’,‘recycling’and‘disposal’laiddowninArticle3ofDirective2008/98/ECshallapply.Article4ProductdesignMemberStatesshall,withoutprejudicetotherequirementsofUnionlegislationontheproperfunctioningoftheinternalmarketandonproductdesign,includingDirective2009/125/EC,encouragecooperationbetweenproducersandrecyclersandmeasurestopromotethedesignandproductionofEEE,notablyinviewoffacilitatingre-use,dismantlingandrecoveryofWEEE,itscomponentsandmaterials.Inthiscontext,MemberStatesshalltakeappropriatemeasuressothattheecodesignrequirementsfacilitatingre-useandtreatmentofWEEEestablishedintheframeworkofDirective2009/125/ECareappliedandproducersdonotprevent,throughspecificdesignfeaturesormanufacturingprocesses,WEEEfrombeingre-used,unlesssuchspecificdesignfeaturesormanufacturingprocessespresentoverridingadvantages,forexample,withregardtotheprotectionoftheenvironmentand/orsafetyrequirements.Article5Separatecollection1.MemberStatesshalladoptappropriatemeasurestominimisethedisposalofWEEEintheformofunsortedmunicipalwaste,toensurethecorrecttreatmentofallcollectedWEEEandtoachieveahighlevelofseparatecollectionofWEEE,notably,andasamatterofpriority,fortemperatureexchangeequipmentcontainingozone-depletingsubstancesandfluorinatedgreenhousegases,fluorescentlampscontainingmercury,photovoltaicpanelsandsmallequipmentasreferredtoincategories5and6ofAnnexIII.2.ForWEEEfromprivatehouseholds,MemberStatesshallensurethat:(a)systemsaresetupallowingfinalholdersanddistributorstoreturnsuchwasteatleastfreeofcharge.MemberStatesshallensuretheavailabilityandaccessibilityofthenecessarycollectionfacilities,takingintoaccount,inparticular,thepopulationdensity;(b)whensupplyinganewproduct,distributorsareresponsibleforensuringthatsuchwastecanbereturnedtothedistributoratleastfreeofchargeonaone-to-onebasisaslongastheequipmentisofequivalenttypeandhasfulfilledthesamefunctionsasthesuppliedequipment.MemberStatesmayderogatefromthisprovisionprovidedthattheyensurethatreturningtheWEEEisnottherebymademoredifficultforthefinalholderandthatitremainsfreeofchargeforthefinalholder.MemberStatesmakinguseofthisderogationshallinformtheCommissionthereof;02012L0019—EN—04.07.2018—001.001—7▼B(c)distributorsprovideforthecollection,atretailshopswithsalesareasrelatingtoEEEofatleast400m2,orintheirimmediateproximity,ofverysmallWEEE(noexternaldimensionmorethan25cm)freeofchargetoend-usersandwithnoobligationtobuyEEEofanequivalenttype,unlessanassessmentshowsthatalternativeexistingcollectionschemesarelikelytobeatleastaseffective.Suchassessmentsshallbeavailabletothepublic.WEEEcollectedshallbeproperlytreatedinaccordancewithArticle8;(d)withoutprejudicetopoints(a),(b)and(c),producersareallowedtosetupandtooperateindividualand/orcollectivetake-backsystemsforWEEEfromprivatehouseholdsprovidedthattheseareinlinewiththeobjectivesofthisDirective;(e)havingregardtonationalandUnionhealthandsafetystandards,WEEEthatpresentsahealthandsafetyrisktopersonnelbecauseofcontaminationmayberefusedforreturnunderpoints(a),(b)and(c).MemberStatesshallmakespecificarrangementsforsuchWEEE.MemberStatesmayprovideforspecificarrangementsforthereturnofWEEEpursuanttopoints(a),(b)and(c)forcasesinwhichtheequipmentdoesnotcontainitsessentialcomponentsoriftheequipmentcontainswasteotherthanWEEE.3.MemberStatesmaydesignatetheoperatorsthatareallowedtocollectWEEEfromprivatehouseholdsasreferredtoinparagraph2.4.MemberStatesmayrequirethattheWEEEdepositedatcollectionfacilitiesreferredtoinparagraphs2and3ishandedovertoproducersorthirdpartiesactingontheirbehalforishandedover,forpurposesofpreparingforre-use,todesignatedestablishmentsorundertakings.5.InthecaseofWEEEotherthanWEEEfromprivatehouseholds,andwithoutprejudicetoArticle13,MemberStatesshallensurethatproducersorthirdpartiesactingontheirbehalfprovideforthecollectionofsuchwaste.Article6DisposalandtransportofcollectedWEEE1.MemberStatesshallprohibitthedisposalofseparatelycollectedWEEEwhichhasnotyetundergonethetreatmentspecifiedinArticle8.2.MemberStatesshallensurethatthecollectionandtransportofseparatelycollectedWEEEiscarriedoutinawaywhichallowsoptimalconditionsforpreparingforre-use,recyclingandtheconfinementofhazardoussubstances.Inordertomaximisepreparingforre-use,MemberStatesshallpromotethat,priortoanyfurthertransfer,collectionschemesorfacilitiesprovide,whereappropriate,fortheseparationatthecollectionpointsofWEEEthatistobepreparedforre-usefromotherseparatelycollectedWEEE,inparticularbygrantingaccessforpersonnelfromre-usecentres.02012L0019—EN—04.07.2018—001.001—8▼BArticle7Collectionrate1.WithoutprejudicetoArticle5(1),eachMemberStateshallensuretheimplementationofthe‘producerresponsibility’principleand,onthatbasis,thataminimumcollectionrateisachievedannually.From2016,theminimumcollectionrateshallbe45%calculatedonthebasisofthetotalweightofWEEEcollectedinaccordancewithArticles5and6inagivenyearintheMemberStateconcerned,expressedasapercentageoftheaverageweightofEEEplacedonthemarketinthethreeprecedingyearsinthatMemberState.MemberStatesshallensurethatthevolumeofWEEEcollectedevolvesgraduallyduringtheperiodfrom2016to2019,unlessthecollectionratelaiddowninthesecondsubparagraphhasalreadybeenachieved.From2019,theminimumcollectionratetobeachievedannuallyshallbe65%oftheaverageweightofEEEplacedonthemarketinthethreeprecedingyearsintheMemberStateconcerned,oralternatively85%ofWEEEgeneratedontheterritoryofthatMemberState.Until31December2015,arateofseparatecollectionofatleast4kilogramsonaverageperinhabitantperyearofWEEEfromprivatehouseholdsorthesameamountofweightofWEEEaswascollectedinthatMemberStateonaverageinthethreeprecedingyears,whicheverisgreater,shallcontinuetoapply.MemberStatesmaysetmoreambitiousratesforseparatecollectionofWEEEandshallinsuchacasereportthistotheCommission.2.Inordertoestablishwhethertheminimumcollectionratehasbeenachieved,MemberStatesshallensurethatinformationconcerningtheWEEEthatisseparatelycollectedinaccordancewithArticle5istransmittedtotheMemberStatesfreeofcharge,includingatleastinformationonWEEEthathasbeen:(a)receivedbycollectionandtreatmentfacilities;(b)receivedbydistributors;(c)separatelycollectedbyproducersorthirdpartiesactingontheirbehalf.3.Bywayofderogationfromparagraph1,Bulgaria,theCzechRepublic,Latvia,Lithuania,Hungary,Malta,Poland,Romania,SloveniaandSlovakiamay,becauseoftheirlackofthenecessaryinfrastructureandtheirlowlevelofEEEconsumption,decideto:(a)achieve,from14August2016,acollectionratethatislowerthan45%buthigherthan40%oftheaverageweightofEEEplacedonthemarketinthethreeprecedingyears;and(b)postponetheachievementofthecollectionratereferredtointhesecondsubparagraphofparagraph1untiladateoftheirownchoicewhichshallnotbelaterthan14August2021.02012L0019—EN—04.07.2018—001.001—9▼B4.TheCommissionshallbeempoweredtoadoptdelegatedactsinaccordancewithArticle20layingdownthenecessarytransitionaladjustmentsinordertoaddressdifficultiesfacedbyMemberStatesinadheringtotherequirementslaiddowninparagraph1.5.InordertoensureuniformconditionsfortheimplementationofthisArticle,theCommissionshall,by14August2015,adoptimplementingactsestablishingacommonmethodologyforthecalculationoftheweightofEEEplacedonthenationalmarketandacommonmethodologyforthecalculationofthequantityofWEEEgeneratedbyweightineachMemberState.ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle21(2).6.TheCommissionshall,by14August2015,presentareporttotheEuropeanParliamentandtotheCouncilonthere-examinationofthedeadlinesrelatingtothecollectionratesreferredtoinparagraph1andonpossiblysettingindividualcollectionratesforoneormorecategoriessetoutinAnnexIII,particularlyfortemperatureexchangeequipment,photovoltaicpanels,smallequipment,smallITandtelecommunicationequipmentandlampscontainingmercury.Thereportshall,ifappropriate,beaccompaniedbyalegislativeproposal.7.IftheCommissionconsiders,onthebasisofanimpactstudy,thatthecollectionratebasedonWEEEgeneratedrequiresrevision,itshallsubmitalegislativeproposaltotheEuropeanParliamentandtheCouncil.Article8Propertreatment1.MemberStatesshallensurethatallseparatelycollectedWEEEundergoespropertreatment.2.Propertreatment,otherthanpreparingforre-use,andrecoveryorrecyclingoperationsshall,asaminimum,includetheremovalofallfluidsandaselectivetreatmentinaccordancewithAnnexVII.3.MemberStatesshallensurethatproducersorthirdpartiesactingontheirbehalfsetupsystemstoprovidefortherecoveryofWEEEusingbestavailabletechniques.Thesystemsmaybesetupbyproducersindividuallyorcollectively.MemberStatesshallensurethatanyestablishmentorundertakingcarryingoutcollectionortreatmentoperationsstoresandtreatsWEEEincompliancewiththetechnicalrequirementssetoutinAnnexVIII.4.TheCommissionshallbeempoweredtoadoptdelegatedactsinaccordancewithArticle20concerningtheamendmentofAnnexVIIinordertointroduceothertreatmenttechnologiesthatensureatleastthesamelevelofprotectionforhumanhealthandtheenvironment.TheCommissionshallevaluate,asamatterofpriority,whethertheentriesregardingprintedcircuitboardsformobilephonesandliquidcrystaldisplaysneedtobeamended.TheCommissionisinvitedtoevaluatewhetheramendmentstoAnnexVIIarenecessarytoaddressnanomaterialscontainedinEEE.02012L0019—EN—04.07.2018—001.001—10▼B5.Forthepurposesofenvironmentalprotection,MemberStatesmaysetupminimumqualitystandardsforthetreatmentoftheWEEEthathasbeencollected.MemberStateswhichoptforsuchqualitystandardsshallinformtheCommissionthereof,whichshallpublishthesestandards.TheCommissionshall,notlaterthan14February2013,requesttheEuropeanstandardisationorganisationstodevelopEuropeanstandardsforthetreatment,includingrecovery,recyclingandpreparingforre-use,ofWEEE.Thosestandardsshallreflectthestateoftheart.InordertoensureuniformconditionsfortheimplementationofthisArticle,theCommissionmayadoptimplementingactslayingdownminimumqualitystandardsbasedinparticularonthestandardsdevelopedbytheEuropeanstandardisationorganisations.ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle21(2).AreferencetothestandardsadoptedbytheCommissionshallbepublished.6.MemberStatesshallencourageestablishmentsorundertakingswhichcarryouttreatmentoperationstointroducecertifiedenvironmentalmanagementsystemsinaccordancewithRegulation(EC)No1221/2009oftheEuropeanParliamentandoftheCouncilof25November2009onthevoluntaryparticipationbyorganisationsinaCommunityeco-managementandauditscheme(EMAS)(1).Article9Permits1.MemberStatesshallensurethatanyestablishmentorundertakingcarryingouttreatmentoperationsobtainsapermitfromthecompetentauthoritiesincompliancewithArticle23ofDirective2008/98/EC.2.Exemptionsfrompermitrequirements,conditionsforexemptionsandregistrationshallbeincompliance,respectively,withArticles24,25and26ofDirective2008/98/EC.3.MemberStatesshallensurethatthepermitortheregistrationreferredtoinparagraphs1and2includesalltheconditionsthatarenecessaryforcompliancewiththerequirementsofArticle8(2),(3)and(5)andfortheachievementoftherecoverytargetssetoutinArticle11.Article10ShipmentsofWEEE1.ThetreatmentoperationmayalsobeundertakenoutsidetherespectiveMemberStateortheUnionprovidedthattheshipmentofWEEEisincompliancewithRegulation(EC)No1013/2006andCommissionRegulation(EC)No1418/2007of29November2007concerningtheexportforrecoveryofcertainwastelistedinAnnexIIIorIIIAtoRegulation(EC)No1013/2006oftheEuropeanParliamentandoftheCounciltocertaincountriestowhichtheOECDDecisiononthecontroloftransboundarymovementsofwastesdoesnotapply(2).(1)OJL342,22.12.2009,p.1.(2)OJL316,4.12.2007,p.6.02012L0019—EN—04.07.2018—001.001—11▼B2.WEEEexportedoutoftheUnionshallonlycounttowardsthefulfilmentofobligationsandtargetssetoutinArticle11ofthisDirectiveif,incompliancewithRegulations(EC)No1013/2006and(EC)No1418/2007,theexportercanprovethatthetreatmenttookplaceinconditionsthatareequivalenttotherequirementsofthisDirective.3.TheCommissionshall,notlaterthan14February2014,adoptdelegatedacts,inaccordancewithArticle20,layingdowndetailedrulessupplementingthoseinparagraph2ofthisArticle,inparticularthecriteriafortheassessmentofequivalentconditions.Article11Recoverytargets1.RegardingallWEEEseparatelycollectedinaccordancewithArticle5andsentfortreatmentinaccordancewithArticles8,9and10,MemberStatesshallensurethatproducersmeettheminimumtargetssetoutinAnnexV.2.Theachievementofthetargetsshallbecalculated,foreachcategory,bydividingtheweightoftheWEEEthatenterstherecoveryorrecycling/preparingforre-usefacility,afterpropertreatmentinaccordancewithArticle8(2)withregardtorecoveryorrecycling,bytheweightofallseparatelycollectedWEEEforeachcategory,expressedasapercentage.Preliminaryactivitiesincludingsortingandstoragepriortorecoveryshallnotcounttowardstheachievementofthesetargets.3.InordertoensureuniformconditionsfortheimplementationofthisArticle,theCommissionmayadoptimplementingactsestablishingadditionalrulesonthecalculationmethodsfortheapplicationoftheminimumtargets.ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle21(2).4.MemberStatesshallensurethat,forthepurposeofcalculatingthesetargets,producersorthirdpartiesactingontheirbehalfkeeprecordsontheweightofWEEE,itscomponents,materialsorsubstanceswhenleaving(output)thecollectionfacility,entering(input)andleaving(output)thetreatmentfacilitiesandwhenentering(input)therecoveryorrecycling/preparingforre-usefacility.MemberStatesshallalsoensurethat,forthepurposesofparagraph6,recordsontheweightofproductsandmaterialswhenleaving(output)therecoveryorrecycling/preparingforre-usefacilityarekept.5.MemberStatesshallencouragethedevelopmentofnewrecovery,recyclingandtreatmenttechnologies.02012L0019—EN—04.07.2018—001.001—12▼B6.OnthebasisofareportoftheCommissionaccompanied,ifappropriate,byalegislativeproposal,theEuropeanParliamentandtheCouncilshall,by14August2016,re-examinetherecoverytargetsreferredtoinAnnexV,Part3,examinethepossibilityofsettingseparatetargetsforWEEEtobepreparedforre-useandre-examinethecalculationmethodreferredtoinparagraph2withaviewtoanalysingthefeasibilityofsettingtargetsonthebasisofproductsandmaterialsresulting(output)fromtherecovery,recyclingandpreparationforre-useprocesses.Article12FinancinginrespectofWEEEfromprivatehouseholds1.MemberStatesshallensurethatproducersprovideatleastforthefinancingofthecollection,treatment,recoveryandenvironmentallysounddisposalofWEEEfromprivatehouseholdsthathasbeendepositedatcollectionfacilitiessetupunderArticle5(2).2.MemberStatesmay,whereappropriate,encourageproducerstofinancealsothecostsoccurringforcollectionofWEEEfromprivatehouseholdstocollectionfacilities.3.Forproductsplacedonthemarketlaterthan13August2005,eachproducershallberesponsibleforfinancingtheoperationsreferredtoinparagraph1relatingtothewastefromhisownproducts.Theproducermaychoosetofulfilthisobligationeitherindividuallyorbyjoiningacollectivescheme.MemberStatesshallensurethateachproducerprovidesaguaranteewhenplacingaproductonthemarketshowingthatthemanagementofallWEEEwillbefinancedandshallensurethatproducersclearlymarktheirproductsinaccordancewithArticle15(2).Thisguaranteeshallensurethattheoperationsreferredtoinparagraph1relatingtothisproductwillbefinanced.TheguaranteemaytaketheformofparticipationbytheproducerinappropriateschemesforthefinancingofthemanagementofWEEE,arecyclinginsuranceorablockedbankaccount.4.TheresponsibilityforthefinancingofthecostsofthemanagementofWEEEfromproductsplacedonthemarketonorbefore13August2005(‘historicalwaste’)shallbebornebyoneormoresystemstowhichallproducersexistingonthemarketwhentherespectivecostsoccurcontributeproportionately,e.g.inproportiontotheirrespectiveshareofthemarketbytypeofequipment.5.MemberStatesshalltakethenecessarymeasurestoensurethatappropriatemechanismsorrefundproceduresaredevelopedforthereimbursementofcontributionstotheproducerswhereEEEistransferredforplacingonthemarketoutsidetheterritoryoftheMemberStateconcerned.Suchmechanismsorproceduresmaybedevelopedbyproducersorthirdpartiesactingontheirbehalf.02012L0019—EN—04.07.2018—001.001—13▼B6.TheCommissionisinvitedtoreport,by14August2015,onthepossibilityofdevelopingcriteriatoincorporatetherealend-of-lifecostsintothefinancingofWEEEbyproducers,andtosubmitalegislativeproposaltotheEuropeanParliamentandtheCouncilifappropriate.Article13FinancinginrespectofWEEEfromusersotherthanprivatehouseholds1.MemberStatesshallensurethatthefinancingofthecostsforthecollection,treatment,recoveryandenvironmentallysounddisposalofWEEEfromusersotherthanprivatehouseholdsresultingfromproductsplacedonthemarketafter13August2005istobeprovidedforbyproducers.Forhistoricalwastebeingreplacedbynewequivalentproductsorbynewproductsfulfillingthesamefunction,thefinancingofthecostsshallbeprovidedforbyproducersofthoseproductswhensupplyingthem.MemberStatesmay,asanalternative,providethatusersotherthanprivatehouseholdsalsobemade,partlyortotally,responsibleforthisfinancing.Forotherhistoricalwaste,thefinancingofthecostsshallbeprovidedforbytheusersotherthanprivatehouseholds.2.Producersandusersotherthanprivatehouseholdsmay,withoutprejudicetothisDirective,concludeagreementsstipulatingotherfinancingmethods.Article14Informationforusers1.MemberStatesmayrequireproducerstoshowpurchasers,atthetimeofsaleofnewproducts,thecostsofcollection,treatmentanddisposalinanenvironmentallysoundway.Thecostsmentionedshallnotexceedthebestestimateoftheactualcostsincurred.2.MemberStatesshallensurethatusersofEEEinprivatehouseholdsaregiventhenecessaryinformationabout:(a)therequirementnottodisposeofWEEEasunsortedmunicipalwasteandtocollectsuchWEEEseparately;(b)thereturnandcollectionsystemsavailabletothem,encouragingthecoordinationofinformationontheavailablecollectionpointsirrespectiveoftheproducersorotheroperatorswhichhavesetthemup;(c)theirroleincontributingtore-use,recyclingandotherformsofrecoveryofWEEE;(d)thepotentialeffectsontheenvironmentandhumanhealthasaresultofthepresenceofhazardoussubstancesinEEE;(e)themeaningofthesymbolshowninAnnexIX.02012L0019—EN—04.07.2018—001.001—14▼B3.MemberStatesshalladoptappropriatemeasuressothatconsumersparticipateinthecollectionofWEEEandtoencouragethemtofacilitatetheprocessofre-use,treatmentandrecovery.4.WithaviewtominimisingthedisposalofWEEEasunsortedmunicipalwasteandtofacilitatingitsseparatecollection,MemberStatesshallensurethatproducersappropriatelymark—preferablyinaccordancewiththeEuropeanstandardEN50419(1)—EEEplacedonthemarketwiththesymbolshowninAnnexIX.Inexceptionalcases,wherethisisnecessarybecauseofthesizeorthefunctionoftheproduct,thesymbolshallbeprintedonthepackaging,ontheinstructionsforuseandonthewarrantyoftheEEE.5.MemberStatesmayrequirethatsomeoralloftheinformationreferredtoinparagraphs2,3and4shallbeprovidedbyproducersand/ordistributors,e.g.intheinstructionsforuse,atthepointofsaleandthroughpublicawarenesscampaigns.Article15Informationfortreatmentfacilities1.Inordertofacilitatethepreparationforre-useandthecorrectandenvironmentallysoundtreatmentofWEEE,includingmaintenance,upgrade,refurbishmentandrecycling,MemberStatesshalltakethenecessarymeasurestoensurethatproducersprovideinformationfreeofchargeaboutpreparationforre-useandtreatmentinrespectofeachtypeofnewEEEplacedforthefirsttimeontheUnionmarketwithinoneyearaftertheequipmentisplacedonthemarket.Thisinformationshallidentify,asfarasitisneededbycentreswhichprepareforre-useandtreatmentandrecyclingfacilitiesinordertocomplywiththeprovisionsofthisDirective,thedifferentEEEcomponentsandmaterials,aswellasthelocationofdangeroussubstancesandmixturesinEEE.Itshallbemadeavailabletocentreswhichprepareforre-useandtreatmentandrecyclingfacilitiesbyproducersofEEEintheformofmanualsorbymeansofelectronicmedia(e.g.CD-ROM,onlineservices).2.InordertoenablethedateuponwhichtheEEEwasplacedonthemarkettobedeterminedunequivocally,MemberStatesshallensurethatamarkontheEEEspecifiesthatthelatterwasplacedonthemarketafter13August2005.Preferably,theEuropeanStandardEN50419shallbeappliedforthispurpose.Article16Registration,informationandreporting1.MemberStatesshall,inaccordancewithparagraph2,drawuparegisterofproducers,includingproducerssupplyingEEEbymeansofdistancecommunication.ThatregistershallservetomonitorcompliancewiththerequirementsofthisDirective.(1)AdoptedbyCenelecinMarch2006.02012L0019—EN—04.07.2018—001.001—15▼BProducerssupplyingEEEbymeansofdistancecommunicationasdefinedinArticle3(1)(f)(iv)shallberegisteredintheMemberStatethattheysellto.WheresuchproducersarenotregisteredintheMemberStatethattheyaresellingto,theyshallberegisteredthroughtheirauthorisedrepresentativesasreferredtoinArticle17(2).2.MemberStatesshallensurethat:(a)eachproducer,oreachauthorisedrepresentativewhereappointedunderArticle17,isregisteredasrequiredandhasthepossibilityofenteringonlineintheirnationalregisterallrelevantinformationreflectingthatproducer’sactivitiesinthatMemberState;(b)uponregistering,eachproducer,oreachauthorisedrepresentativewhereappointedunderArticle17,providestheinformationsetoutinAnnexX,PartA,undertakingtoupdateitasappropriate;(c)eachproducer,oreachauthorisedrepresentativewhereappointedunderArticle17,providestheinformationsetoutinAnnexX,PartB;(d)nationalregistersprovidelinkstoothernationalregistersontheirwebsitetofacilitate,inallMemberStates,registrationofproducersor,whereappointedunderArticle17,authorisedrepresentatives.3.InordertoensureuniformconditionsfortheimplementationofthisArticle,theCommissionshalladoptimplementingactsestablishingtheformatforregistrationandreportingandthefrequencyofreportingtotheregister.ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle21(2).4.MemberStatesshallcollectinformation,includingsubstantiatedestimates,onanannualbasis,onthequantitiesandcategoriesofEEEplacedontheirmarkets,collectedthroughallroutes,preparedforre-use,recycledandrecoveredwithintheMemberState,andonseparatelycollectedWEEEexported,byweight.▼M1__________6.MemberStatesshallreportthedataconcerningtheimplementationofparagraph4foreachcalendaryeartotheCommission.Theyshallreportthedataelectronicallywithin18monthsoftheendofthereportingyearforwhichthedataarecollected.ThedatashallbereportedintheformatestablishedbytheCommissioninaccordancewithparagraph9.Thefirstreportingperiodshallstartinthefirstfullcalendaryearaftertheadoptionoftheimplementingactthatestablishestheformatforreporting,inaccordancewithparagraph9,anditshallcoverthedataforthatreportingperiod.7.ThedatareportedbyMemberStatesinaccordancewithparagraph6shallbeaccompaniedbyaqualitycheckreport.02012L0019—EN—04.07.2018—001.001—16▼M18.TheCommissionshallreviewthedatareportedinaccordancewithparagraph6andpublishareportontheresultsofitsreview.Thereportshallassesstheorganisationofthedatacollection,thesourcesofdataandthemethodologyusedinMemberStatesaswellasthecompleteness,reliability,timelinessandconsistencyofthatdata.Theassessmentmayincludespecificrecommendationsforimprovement.ThereportshallbedrawnupafterthefirstreportingofthedatabytheMemberStatesandeveryfouryearsthereafter.9.TheCommissionshalladoptimplementingactslayingdowntheformatforreportingthedatareferredtoinparagraph6ofthisArticle.ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle21(2).Article16aIncentivesfortheapplicationofthewastehierarchyInordertocontributetotheobjectiveslaiddowninthisDirective,MemberStatesmaymakeuseofeconomicinstrumentsandothermeasurestoprovideincentivesfortheapplicationofthewastehierarchy,suchasthoseindicatedinAnnexIVatoDirective2008/98/ECorotherappropriateinstrumentsandmeasures.▼BArticle17Authorisedrepresentative1.EachMemberStateshallensurethataproducerasdefinedinArticle3(1)(f)(i)to(iii)establishedinanotherMemberStateisallowed,bywayofexceptiontoArticle3(1)(f)(i)to(iii),toappointalegalornaturalpersonestablishedonitsterritoryastheauthorisedrepresentativethatisresponsibleforfulfillingtheobligationsofthatproducer,pursuanttothisDirective,onitsterritory.2.EachMemberStateshallensurethataproducerasdefinedinArticle3(1)(f)(iv)andestablishedonitsterritory,whichsellsEEEtoanotherMemberStateinwhichitisnotestablished,appointsanauthorisedrepresentativeinthatMemberStateasthepersonresponsibleforfulfillingtheobligationsofthatproducer,pursuanttothisDirective,ontheterritoryofthatMemberState.3.Appointmentofanauthorisedrepresentativeshallbebywrittenmandate.Article18AdministrativecooperationandexchangeofinformationMemberStatesshallensurethatauthoritiesresponsibleforimplementingthisDirectivecooperatewitheachother,inparticulartoestablishanadequateflowofinformationtoensurethatproducerscomplywiththeprovisionsofthisDirectiveand,whereappropriate,provideeachotherandtheCommissionwithinformationinordertofacilitatetheproperimplementationofthisDirective.Theadministrativecooperationandexchangeofinformation,inparticularbetweennationalregisters,shallincludeelectronicmeansofcommunication.02012L0019—EN—04.07.2018—001.001—17▼BCooperationshallinclude,interalia,grantingaccesstotherelevantdocumentsandinformationincludingtheresultsofanyinspections,subjecttotheprovisionsofthedataprotectionlawinforceintheMemberStateoftheauthoritywhichisrequestedtocooperate.Article19Adaptationtoscientificandtechnicalprogress▼M1TheCommissionisempoweredtoadoptdelegatedactsinaccordancewithArticle20ofthisDirectiveconcerningtheamendmentsnecessaryinordertoadaptAnnexesIV,VII,VIIIandIXtothisDirectivetoscientificandtechnicalprogress.TheCommissionshalladoptaseparatedelegatedactinrespectofeachAnnextobeamended.WhenamendingAnnexVIItothisDirective,theexemptionsgrantedunderDirective2011/65/EUoftheEuropeanParliamentandoftheCouncil(1)shallbetakenintoconsideration.▼BBeforetheAnnexesareamended,theCommissionshall,interalia,consultproducersofEEE,recyclers,treatmentoperatorsandenvironmentalorganisationsandemployees’andconsumerassociations.Article20Exerciseofthedelegation1.ThepowertoadoptdelegatedactsisconferredontheCommissionsubjecttotheconditionslaiddowninthisArticle.2.ThepowertoadoptdelegatedactsreferredtoinArticle7(4),Article8(4),Article10(3)andArticle19shallbeconferredontheCommissionforaperiodoffiveyearsfrom13August2012.TheCommissionshalldrawupareportinrespectofthedelegationofpowernotlaterthanninemonthsbeforetheendofthefive-yearperiod.Thedelegationofpowershallbetacitlyextendedforperiodsofanidenticalduration,unlesstheEuropeanParliamentortheCouncilopposessuchextensionnotlaterthanthreemonthsbeforetheendofeachperiod.3.ThedelegationofpowerreferredtoinArticle7(4),Article8(4),Article10(3)andArticle19mayberevokedatanytimebytheEuropeanParliamentorbytheCouncil.Adecisiontorevokeshallputanendtothedelegationofthepowerspecifiedinthatdecision.ItshalltakeeffectthedayfollowingthepublicationofthedecisionintheOfficialJournaloftheEuropeanUnionoratalaterdatespecifi
